Things did nоt gо well fоr this yeаr's Wаllа Walla Washington Band Mother's Fundraising Dinner. Every year the Band Mother's Association (yes the name has concerning gender stereotype vibes to it, but the Association and its members will tell you that they like it that way) does a dinner fundraiser to help pay for band uniforms and equipment and for part of the cost of the Band's trip. Each year the executive committee of the association comes up with a menu and arranges for entertainment by band members. This year they decided to include Turkey salad in the dinner, something they had not done before. Eight of the band mothers (we can call them collectively "the band mothers" or "Doe, Rei, Me, Fa, Sew, La, Tea, Doe2.0") volunteered to each cook a turkey at home and then to bring it to the school's band room the day of the dinner to chop up the cooked turkeys and to add all the fixings for a delicious turkey salad (after Thanksgiving left-overs, just the thought of this seems tortious). The eight assembled and went to work chopping up turkey and mixing in crunchy vegetables and gallons of mayonaise, but little seasoning (this is Walla Walla, after all). They then put it in the school lunchroom's refrigerator to stay cold until dinner. Betty Draper, the mother of 9th grade piccolo player, Sally, attended the dinner and ate the variety of offerings. Twenty hours later, she knew that she was terribly sick. In fact she had contracted salmonella, and the salmonella was so bad that eventually she had to undergo surgery to remove a portion of her colon. She lost weeks of work and and endured a long hospital stay. Draper consulted Raymond Vasvari who agreed to take on the case. He has suggested both a negligence claim against the eight band mothers and a strict liability, products liability case against the band mother's association. The County medical examiner determined that twelve other attendees became sick with salmonella, though none of them as seriously as Draper. He also tested some of the remaining turkey salad and found the presence of salmonella in it. He said, we see this often. Somebody didn't cook the turkey long enough or kept it unrefrigerated for too long. The band mothers all insist that their kitchens are spotless and that their food safety regimes are second to none. Knowing just these facts, what are the biggest issues that you think that Draper's lawyer will need to deal with? How should they be decided and why?
