In 2020, Mаrthа Stewаrt purchased a large vineyard in a rural area in nоrthern Westchester Cоunty, New Yоrk. At the time Martha acquired the vineyard, the vineyard had been in continuous operation for over 100 years.  The area surrounding the vineyard was primarily agricultural and was populated by several local beekeepers whose honeybees were highly beneficial to the grape vines.  Bringing her marketing and business expertise to bear on what had previously been an unnoticed vineyard, Martha popularized the vineyard for the delicate flavors of the wine produced there. Martha opened a bottling plant on-site, conducted all marketing operations on-site, and retained a considerable staff of vinedressers and field laborers, employing at least 10% of local residents.  Tourism increased, leading to the growth of the local economy.  In early 2024, the vineyard won a prestigious award for its 2023 bottling, which reviewers praised as having a particularly “clean” flavor, especially for a wine produced in New York.  Unfortunately for Martha, in 2024 Bill Clinton bought a large parcel of land across the road from the vineyard.  With all proper permits from all relevant authorities, Bill opened a commercial propane storage, shipping, and sale operation, which made loud noises and emitted a distinct odor which was discernable up to a half-mile away. Problems at the vineyard began to show themselves immediately.  Local community members made a point to reroute their daily commutes away from the smelly operation, and a significant percentage of the vineyard’s workers quit, citing the smell.  At the next harvest, the vintner (the wine-making staff member) immediately noticed a distinct unpleasant flavor had entered the wine, which was certainly NOT “clean”.  What was worse, all of the local beekeepers relocated their hives to areas away from the propane operation, due to decreased hive strength and discernable flavors in the honey produced in areas close to the propane operation. Martha consults you, her attorney, and wants to know what she can do about the problem. Question 1: (20% of points) Can Martha Stewart sue Bill Clinton under a theory of strict liability for causing harm while engaging in an ultrahazardous activity? Question 2: (80% of points) Assuming all proper notice has been given, will Martha Stewart prevail if she brings an action for nuisance?
