After sаving аll summer tо buy а GameStatiоn videо game console, Dustin had saved enough money to buy the digital Digital GameStation console. With the digital version of the console, Dustin was required to buy games through the GameStation digital store, instead of hard copy discs. The GameStation5 digital console version was cheaper, but did not have a disc drive, and was not capable of playing hard copies of games. After bringing his new GameStation home, Dustin couldn’t wait to play the newest release of his favorite game series, Zombie Slayer 13. Dustin plugged the console in and immediately purchased Zombie Slayer 13 from the digital GameStation store, hastily skipping over the Terms of Service by clicking “agree” to begin his download. He played the game for several weeks, eventually losing interest in favor of other new releases. After a while, months would go by where Dustin did not play Zombie Slayer 13 at all. The next year, a new game, Bass Hero 7, was released. When Dustin went to download it, he realized he did not have room on his GameStation console. Since he hadn’t played it in so long Dustin decided to delete Zombie Slayer 13, thinking he could just re-download it again later if he decided to play it again in the future. After all, has already paid for the game. A few weeks after he deleted the game, one of Dustin’s friends bought her first GameStation5. For her birthday, her boyfriend gave her a used hard copy (disc) of Zombie Slayer 13. When he heard, Dustin excitedly visited the GameStation digital store to re-download his copy so they could play together. Unfortunately, Zombie Slayer 13 had been delisted from the store, and is no longer available. Dustin emailed GameStation’s customer service, asking if he can get a refund for the money he spent on Zombie Slayer 13. Since he paid for the game and it no longer exists on the store, he said he should be compensated. The GameStation representative was not impressed and told him that this scenario was explicitly covered in the GameStation Terms of Service, which states that a “purchase” through the digital store is simply a license to play the game - as long as the game is listed in the digital store. Dustin argued that the digital version of the game was the same price as a physical copy, and his friend with a hard copy could still play it and the situation was unfair. Dustin decides to sue GameStop to get back the $64.99 he spent on his copy of Zombie Slayer 13. Is he likely to be successful?
