Sаmuel kept а hаndgun оn his dresser in his bedrооm which is next to the bedroom door in order to protect himself against intruders. A statute provides that: (1)(a) An owner or possessor of a firearm shall, at all times that the firearm is not carried by or under the control of the owner, possessor or authorized person, secure the firearm: (A) With an engaged trigger or cable lock; (B) In a locked container; or (C) In a gun room. Dillon broke into Samuel’s house while Samuel was sleeping and stole the handgun. Dillon subsequently used the handgun in an attack on Jeffrey in a parking lot of a Convenience store belonging to Pam. Jeffrey had just exited the store around midnight. During the attack, Dillon approached Jeffrey and demanded that he hand over his wallet. Jeffrey refused. Dillon drew the handgun, pointed it at Jeffrey, and stated, “Bad choice, so now I’m going to shoot you.” Jeffrey fainted out of shock and suffered a broken arm. He also now suffers from frequent periods of stress induced panic attacks and related headaches and weight loss. Dillon took his wallet and fled, but was later apprehended by the police. Pam had been aware of several previous attacks on its customers in the parking lot at night during the past several years, but provided extra lighting and a security guard who was on a break and, as a result, didn’t witness the attack. Under what theory or theories, if any, might Jeffrey bring an action for damages against Samuel, Dillon, and Pam? Discuss.
Jeff, Bоbby, аnd Adаm were friends аnd had been cо-cоnspirators in many crimes up to now. Jeff and Bobby asked Adam to help them rob a cigar and spirits shop. Jeff knew they usually had up to $25000.00 on hand at the end of the day because of the many daily cash transactions. Bobby agreed to the idea “as long as long as no one gets hurt.” Adam said “we can take a baseball bat and each have a knife and that will work fine scaring them into giving us the money.” Unbeknownst to Bobby and Adam, Jeff had a drug problem and always carried a gun since he sold drugs frequently and felt he needed in case a deal went bad. The next day, Bobby and Adam showed up to rob the store with their bats and knives but Jeff was there and had his gun as well as a “Rambo” style knife which is about 14 inches long. Bobby and Adam did not know about the gun and they relied on the agreement that no one would get hurt. To those two, this was just a plan to scare the employees and get some fast cash. When they saw Jeff’s gun on Jeff’s hip as they were walking up to the store, Bobby said “I’m out, this is too dangerous and I don’t play with guns”. He walked away but stood off at a distance. He figured it could not hurt to watch but didn’t want to go through with it. Upon entering the store, Jeff demanded the money from the clerk at the register named Thomas, showed the gun, and said “turn over all the money that is in the safe or I will shoot.” He grabbed money from the cash register and demanded the rest. Riggs, a detective with the LAPD, happened to be there buying his favorite cigars when Jeff made the threat. Riggs pulled a gun and shot at Jeff and Adam after ordering them to drop the weapons. He hit Jeff but missed Adam. Jeff was not fatally injured. As Jeff was hit, he returned fire hitting Thomas who died at the scene from the gunshot. With what crimes might Jeff, Adam, Bobby, and Thomas be charged? What defenses might exist?
