Jоhn аnd Kаrmin were mаrried оn Friday, September 23, 2025, at the cоurthouse in Anchorage. Karmin came into your law office today seeking an annulment of her marriage to John. She says that marrying John was a terrible mistake. Karmin and John had been dating for close to eight months when they got married. They met initially at Koots and had been physically intimate since the start of their relationship. Karmin is 23 and John is 35. After dating for three months, Karmin moved out of her apartment and into John’s house, where she has lived ever since. John has a problem with alcoholism and sometimes becomes physically abusive toward Karmin when he is drinking. Very early in the relationship, John started pressuring Karmin to marry him, promising to take care of her. John is financially stable and has the means to support Karmin and any family the two of them might have.   Karmin agreed on Sunday, September 18, 2025, to marry John, and the two of them went the next day to obtain a marriage license. Karmin says that she agreed to marry John because she thought she might be pregnant but had yet to take a pregnancy test. She did not tell John about the potential pregnancy. Karmin does not have any family in Alaska and was worried that she would have trouble financially as a single mother. Karmin works as a store clerk and makes minimum wage; John makes $100,000 per year as a banking executive. Karmin also felt that it is important that children be raised by married parents. Karmin did not tell John that she might be pregnant, wanting to wait until she could confirm it.   Instead of spending time with his new wife the evening of the wedding, John went to a bar with some friends to celebrate. Karmin used her free time to take a home pregnancy test and found out that she was not in fact pregnant. When John returned that evening after drinking with his friends, Karmin told John, who was noticeably drunk, about the negative pregnancy test. John became enraged with Karmin for not telling him in the first place about the possible pregnancy and beat her severely. John then insisted that the two of them have sex, yelling at Karmin “If you’re not pregnant now, I’ll make you pregnant!” Karmin did not want to have sex with John, but was too afraid to leave, and as she had done many times before consented to sexual intercourse. The next morning, John apologized to Karmin for hitting her the night before (though not for the rape). John begged Karmin not to file for a protective order or report him to the police. John also argued that it was partially Karmin’s fault for not being more honest with him about the possible pregnancy. Karmin suffered from low self-esteem and was stuck in the cycle of abuse. She agreed with John that she should have been more open with him about the possible pregnancy, but said she would only forgive John and stay with him if he promised to go to alcohol abuse treatment. By Saturday, September 27, John had enrolled in and was attending a one-month residential alcohol abuse program. Karmin was initially appreciative that John enrolled in the treatment program, but after discussing her marriage with some girlfriends, Karmin decided that she no longer wanted to be married to John and that the marriage had been a mistake. Karmin has come to you for legal advice. Karmin wants to annul her marriage to John because she wants to wipe her marital history clean and not have to explain to any future partners her marriage to John. Karmin does not want any property or other payment from John. Please draft a letter to Karmin explaining her legal options for an annulment, the various arguments she can make, and your opinion on the strengths and weaknesses of each argument.
