Hаrry purchаsed а new Prius statiоn wagоn frоm Smalltown Motors. Harry used his new car for business and pleasure driving. On occasion, for purposes of his work, Harry used his station wagon to transport a highly flammable liquid that was stored in ordinary glass jugs. One day, Harry was transporting the jugs on the freeway when a big rig driving in front of him suddenly slammed on its brakes. Harry swerved in order to attempt to miss the bog rig truck and as he applied the brakes, the brakes failed, causing Harry’s car to hit Mary’s car at 60 mph. The impact caused Mary’s car to overturn and the jugs in the back of Harry’s station wagon to break, spilling the chemicals over the freeway. Moments later, a physician who had been driving on the freeway, pulled his car over to attempt to provide medical assistance to Mary, who had been pinned under her car. As he approached Mary’s car, the physician slipped on the spilled chemicals, herniating a disc in his back. If Harry asserts a strict liability claim against Smalltown Motors, will he prevail?
