Essаy 2 (60 minutes)Shipyаrd Inc. оwns аnd оperates a repair shipyard where a Ship was brоught for repairs.  Shipyard hired Harbor Repair (Harbor) to remove debris from the Ship.  Shipyard erected a long scaffold of used lumber from its lumberyard.  The scaffold extended on one side of the Ship, for the length of the Ship, just below the Ship deck, well above the level of the dock, nearby to where the truck to carry away the debris would be located.  Shipyard’s safety inspector, Sal, inspected the scaffold prior to use by visual examination from the dock, and found it safe.  Harbor’s site manager did not inspect the scaffold due to time constraints.Bill, an employee of Harbor, arrived at Shipyard to unload the debris from the Ship, and was told by Harbor’s site manager to relay the debris from the Ship deck to the scaffold to the truck.  Bill climbed down onto the scaffolding, thinking it felt very wobbly.  As Bill stood on the scaffold, waiting for other employees to hand him the debris, the flooring of the scaffolding gave way as one of the boards broke jaggedly in half, and Bill fell between the dock and the Ship, suffering severe injuries.Immediately after the incident, Shipyard’s managers brought Sal in for questioning.  Shipyard management personnel yelled at Sal repeatedly, waiving his inspection report in his face, calling him derogatory names, and threatening to fire him, until Sal felt queasy and short of breath.  When state accident investigators arrived at Shipyard, management locked Sal into a back room to avoid any questioning.  Sal agreed it would be good for him to stay out of sight, but feared he might be in trouble later with inspectors for hiding.  He tried to get out, but found out he was locked in anyway.On what theory or theories might an action for damages be brought and what defenses might be asserted by:Bill against Shipyard?  Discuss.Bill against Harbor?  Discuss.Sal against Shipyard?  Discuss.
