Essаy 1 Henry аnd Wilmа married in San Diegо, Califоrnia in 2005. They went thrоugh all the steps necessary to formalize and legalize their marriage. Prior to his marriage to Wilma, Henry was married to Fran in 2000 and they separated in 2003. Fran had told Henry she wanted a divorce and that she would take care of everything. Since Henry and Fran had not acquired much in terms of property or had any children, he did not see the need to be involved in the divorce. Fran started the proceedings and sent paperwork to Henry. Fran told Henry he did not have to respond and that she would default him and the court would automatically enter a judgment without either one ever having to step foot in the court. When Henry received the divorce papers from Fran, he reviewed them, but did not sign anything or respond to them, as Fran told him she would take care of everything. Once Henry met Wilma, he forgot all about his marriage to Fran and never once did he call her up to check on the status of the divorce or seek to obtain his own records to confirm he was divorced. He just assumed he was divorced and when he met Wilma, he informed her that he had been married before, but was divorced. Wilma took him for his word. Wilma did not work during the marriage and stayed home to care for the couple’s two children. Henry was the vice-president of a technology company and earned a decent wage. Wilma had always wanted a swimming pool in the back yard, but Henry always opposed and said it was a hassle to maintain. In 2015, Wilma’s mother died and left her an inheritance of $50,000. Wilma deposited $30,000 into the couple’s joint checking account where Henry’s direct deposit from his employment would go and she opened up a separate account in just her name and deposited $20,000 into this account. After a few months, the couple received a bill for taxes due on their community property residence in the amount of $10,000. Henry and Wilma used the inheritance money from the joint account to pay for this. The couple also decided the house needed some maintenance, such as painting and spent another $5,000 from the joint account. Wilma was still wanting a swimming pool, so she decided to install one and used the $20,000 from her the account in her name only to pay for it. The joint account still had $15k of Wilma’s inheritance money. The swimming pool was a hit and everyone, including Henry enjoyed using the pool and it made the backyard look like a million bucks. Sadly, in 2017 Henry and Wilma separate and Henry moves out of the home. Wilma is having a hard time dealing with the separation so she starts going to counseling. Since Henry is carrying the medical insurance, the bills are being sent to him. Wilma has incurred $2,000 in counseling fees. Henry finds out after he separates from Wilma, that Fran never followed through with the divorce and he is still legally married to Fran. Assuming Henry and Wilma will divorce, how will the courts resolve the following: 1. What is the legality of Henry and Wilma’s marriage? (Do not discuss any claims of Fran) 2. Characterization of the $50,000 received by Wilma? Discuss. 3. Wilma being reimbursed for the $20,000 used for the swimming pool? Discuss 4. Wilma being reimbursed for the $10,000 paid for taxes? Discuss 5. Wilma being reimbursed for the $5,000 spent on maintenance? Discuss 6. Wilma’s argument that the remaining $15,000 in the joint account is her SP 7. Financial responsibility of the $2,000 in counseling fees? Discuss.
