QUESTION 1 - 5 Pоints Celebrаtiоn Wedding Plаnners ("CWP") entered intо а contract with Laura and Jim to plan their wedding.  CWP agreed to handle all planning for Laura and Jim’s wedding, to make sure all invitations were sent out, to reserve the location for the wedding and the reception, to reserve the photographer, caterers, and cake maker.   Laura and Jim agreed to pay CWP the price of $18,000.   Laura and Jim were very busy and allowed CWP to handle all aspects of the planning without much oversight.  As the day of the wedding approached, Laura and Jim began to realize that things were not going as planned.  The cake maker they had chosen with CWP indicated that they had never actually been contacted to make the cake, the caterer had the wrong meal selections, and certain invitations had failed to go to the correct addresses.  Laura and Jim were very upset.  The wedding actually occurred, in large part because Laura and Jim scrambled to fix CWP’s mistakes.   After the wedding CWP sent Laura and Jim an invoice for $18,000.  Laura immediately sent an email to CWP which stated:  “You almost ruined our day.  We hired you to handle everything and you missed several important details.  We had to spend extra to get the cake made and had to call many close friends and relatives to see if they could make it at the last minute.   Now you claim that we still owed you $18,000.  No way are we paying that amount.”  CWP responded that it expected payment of $18,000 within ten days or it would sue.  CWP claimed that it was Laura and Jim’s failure to assist that really caused the mistakes.   The parties engaged in several heated conversations over the next week.  Finally, Laura and Jim sent payment in the amount of $10,000 to CWP with a note that stated:  This is all you will get from us.  Sue us if you want.”   CWP deposited the $10,000 payment into its bank account and, six months later, sued Laura and Jim demanding an additional $8,000.         REQUIRED (6 Points):  Will CWP prevail?  Discuss.

At the time, Katie could afford the rent because she had a high paying job as a patent attorney.   After three years of renting the apartment, Katie lost her job.  Katie could no longer afford to pay $9,500 per month and approached Samson about modifying the lease. Katie told Samson that she could probably afford rent in the amount of $6,000 per month because of her savings.  Samson could not afford to lose another tenant in his building but he was also mad at Katie trying to renegotiate her lease payment.  Samson told Katie that he would agree to the decreased monthly rent payments if Katie agreed to extend his lease by another year – so that the total lease term would now be 6 years instead of five. Katie agreed. Samson’s lawyer prepared a simple one-page amendment to the lease which provided that the monthly rent would decrease to $6,000 per month and that Katie would agree to extend her lease term by one year, for a total lease term of six years. Both Samson and Katie signed the amendment. Katie began paying $6,000 per month. After three months Gill approached Samson and indicated that he really wants Katie’s apartment and is willing to pay more than $9,500 a month in rent.  Samson now wants out of the lease and lease amendment he entered into with Katie so that he can rent to Gill at the higher rent. Samson sent Katie a letter telling her that the amendment was unenforceable because it lacked consideration. Katie does not want to leave the apartment.
