Questiоn 1: SCOTUS Cоmpаrisоn   This question requires you to compаre а Supreme Court case you studied in class with one you have not studied in class. A summary of the Supreme Court case you did not study in class is presented below and provides all of the information you need to know about this case to answer the prompt. After reading the passage, respond to A, B, and C below.   In 1968, members of the Edgewood Concerned Parent Association filed a lawsuit in a Texas District Court challenging that the system of using property taxes as the main source of revenue for school districts discriminated against poorer school districts. They provided evidence showing that wealthier schools serving primarily white students spent more money per pupil than poorer schools, especially those with minority populations. Without a wealthy tax base to fund their schools, they argued that poorer students’ Fourteenth Amendment rights were being violated. The case was brought before the Supreme Court in San Antonio Independent School District v. Rodriguez (1973). In a 5-4 decision, which was divided along ideological lines, the Supreme Court ruled that the students’ constitutional rights were not violated by the Texas school funding plan. In writing the majority opinion, Justice Powell stated that “the Texas plan is not the result of hurried, ill-conceived legislation. It certainly is not the product of purposeful discrimination against any group or class. On the contrary, it is rooted in decades of experience in Texas and elsewhere, and, in major part, is the product of responsible studies by qualified people.”   Identify the clause of the Fourteenth Amendment that is common to both Brown v. Board of Education of Topeka (1954) and San Antonio Independent School District v. Rodriguez (1973). Explain how the difference in facts led to a different decision in both Brown v. Board of Education of Topeka and San Antonio Independent School District v. Rodriguez. Explain how the outcome in San Antonio Independent School District v. Rodriguez demonstrates how public policy regarding equality of opportunity is affected by federalism in the United States.

Questiоn 3: Quаntitаtive Anаlysis   Identify a change in federal spending between 1970 and 2023 (prоjected) based оn the chart above. Describe the difference between entitlement programs and discretionary programs. Describe one demographic trend that has contributed to changes in entitlement spending. Explain why changes in entitlement spending make balancing the federal budget difficult.

Questiоn 2: Cоncept Applicаtiоn   Beginning in the 1960s, the Supreme Court issued а series of rulings which аpply constitutional protections to places where a person might have a “reasonable expectation of privacy,” including areas outside the home. As the internet developed, questions emerged about where internet communication takes place and the level of privacy protection email users can expect. In the case United States v. Microsoft (2018), the federal government issued Microsoft Corporation a warrant to hand over to authorities email communications between some of its users. Federal law enforcement alleged that one of Microsoft’s email users was operating an account to facilitate illegal drug trafficking. Microsoft refused to comply with the warrant, claiming that its servers were located in Ireland and thus not within the jurisdiction of the federal government. Before the Supreme Court decided the case, Congress intervened by passing the CLOUD Act, which required internet-based companies to hand over communications requested in a warrant so long as both the federal government and the foreign government agreed. Microsoft and other internet companies accepted the new legislation, but the law raised concerns among many groups that civil liberties were being violated. After reading the scenario, please respond to A, B, and C below. Referencing the scenario, describe the constitutional amendment that is most relevant to the Supreme Court case, and explain how the actions taken by the federal government prior to accessing emails illustrate the protection of a constitutional liberty. Explain how passage of the CLOUD Act reflects a tension between balancing order and liberty in the American political system. Describe the section of the Constitution that grants Congress the power to pass the CLOUD Act, and explain how this power reflects the principle of checks and balances reflected in the scenario.
