Barry believes Judge Peace made a mistake by disregarding his rights and decides to disregard the order. Without holding a trial, Judge Peace holds Barry in contempt, fining him $500 for each day he continues to play music outdoors. Barry continues to play the music for 5 additional days until it is ultimately determined by a different judge that the ordinance is unconstitutional. The court determines that a permanent injunction should not be issued. Furthermore, the court also determined the preliminary injunction should be dismissed.
