One of Spencer's neighbors called local police to report that she had been in Spencer's home and that she had seen the stolen artwork hanging on his living room wall. While Officer Duty was drafting an application for a warrant to search Spencer's home, based upon this and other information, the same neighbor happened to see another officer in the neighborhood. She told this officer, Officer Hasty, the same story and that the stolen painting could be seen (brazenly) hanging in Spencer's living room, even from the sidewalk in front of his home. Hasty went directly to Spencer's home, and simply by looking through his large front window from the street, Hasty could see a lovely piece of artwork hanging in the living room. Without bothering to confirm any part of the neighbor's story (including that a burglary had even occurred), Hasty went up to Spencer's home, rang the doorbell, and arrested Spencer when he came to the door. Hasty then marched into the home and retrieved the painting. He was in the process of putting the painting in his trunk when Officer Duty arrived with a lawful warrant to search Spencer's home. Spencer has been charged with burglary and with theft of the painting. His counsel has moved to suppress the painting and any evidence that it was recovered from within Spencer's home.
