Severаl Africаn Americаn dancers that wоrked as dancers at FantasyLand, a cabaret night club in Mississippi filed a cоmplaint with the EEOC fоr race discrimination. The club employs more than 20 workers. Your investigation revealed that African American dancers at the club were subjected to discriminatory terms of employment. For example, they were limited in the number of shifts they could work. You also found those same dancers were required to dance at another night club owned by the same owner, for less pay and with less security, even though doing so could result in arrest, because they were not licensed by the county to dance at the other club. African American dancers who refused to work at the other club were “fined” or sent home by the owner. You are the EEOC investigator investigating this complaint. What federal statute has been violated, and what statutory factors must be established in order to create a prima facie case? In other words, identify the statute (by full name), the type of claim at issue within that statute (disparate treatment, impact, retaliation, etc.), and identify and explain each element of that claim that the EEOC would need to establish in order to proceed in a case against this company. Then (in a new paragraph), apply each of those elements to our case and arrive at a conclusion whether the statute was violated or not. Essay response must cite to both the Ch. 6 lecture and Ch. 6 of the textbook and must only reference the statutes and types of claims discussed in chapters 6 textbook/lecture. Lastly, if the EEOC successfully proves the violation you identified, what must the defendant show to overcome that proof (and win the case)? This last question requires case law support.* * Note: This essay requires case law support. Remember from our work in week one (learning how to create case briefs using the IRAC method) that legal decisions must be supported by law – statute, precedent, etc. Thus, you must identify a relevant case (one that has similar facts and similar issue) that was assigned for this chapter (SEE SYLLABUS) that would be binding on this case when writing your answer. Your answer must discuss the facts of the cited case, how those facts are relevant to our case, what the holding was in the cited case, then apply that holding (precedent) to our case to explain the conclusion you reach in our case. HINT: What does the binding case say a defendant must show once the plaintiff proves their case?
