On Fridаy night аrоund 11:00pm, Deputy Pаdilla оbserved a silver SUV cоming to a rolling stop at an intersection with a flashing red light before turning right on Farm-to-Market Road 2222. He followed the vehicle and observed the vehicle cross the center stripe twice. The deputy initiated a traffic stop and the driver of the SUV immediately responded by safely pulling over onto the shoulder of the highway. When the deputy approached the driver side window of the vehicle he saw 4 Hispanic males in the vehicle, two in the front and two in the back. He did not smell the odor of any alcoholic beverage or the odor of burning marihuana. However, as he was shining his flashlight into the vehicle to observe the driver removing his license from his wallet, he observed a clear plastic baggie containing a green leafy substance in plain view on the center console. Based on his experience in narcotics investigation, he believed the baggie contained marihuana. He had each of the subjects step out of the vehicle and had them stand in separate locations, while he retrieved the baggie of marihuana. He also quickly searched the passenger compartment and found a pipe, which looked like it was new. In identifying and interviewing the young subjects he realized he knew them from the local soccer league and also knew their families. Each of the young men indicated they had gotten the marihuana from an acquaintance and had purchased a pipe. They were headed out into the country to a pasture party to meet a group of friends and they were going to smoke the marihuana at the party. None of the subjects appeared to be under the influence of drugs or alcohol. Rather than arrest them for a Class B misdemeanor, the deputy had the driver dump the marihuana in the tall grass along the road. The deputy then instructed them to drive back to town and he followed them to edge of town. He then resumed his patrol.
