Oceаn Ridge Hоspitаl System hаs just built a hоspital оn a stretch of Highway in Galveston Texas at a cost of 23 million Dollars which is virtually the only Hospital accessible by air, sea, and land near Galveston.  While there are other hospitals in Texas, this one is uniquely situated on the main highway and also accessible via water to service fishing vessels and the coast guard for maritime injuries.  As there is no power station in reach of this hospital, it installed two large generators at its base which are powered by twin Diesel engines which produce noxious but not harmful smells and sounds of about 45-80 decibels during the day and lessen to about 20 decibels at night.  Harmful decibels are considered those of 85 and above.  Prior to the hospital being built, a 36-unit apartment building called “Galveston Ocean Ridge Apartments” was erected just 50 yards from the hospital.  The residents now complain of the persistent smell and noise from the Hospital and say they moved to Galveston for peace and quiet, not for diesel engine noise and smelly air.   The head of the Hospital system has testified that if they are forced to move the hospital or shut down, the company will be bankrupt after the investment they made and that there will be no local hospital available to the fishing industry. The residents of “Ocean Ridge” testify that they would have to keep their windows and doors shut at all times to keep away the smell and sound and they will not be able to allow their children to play outside the apartment building.  They also testified that their $80,000 apartments are not worth $50,000 after the hospital’s construction and the smells and noise. They sue for a permanent injunction against Ocean Ridge Hospital System.  Discuss the doctrine(s) the Court would apply to its evaluation of whether or not to issue a permanent injunction? Discuss the factors the Court would consider, apply these to the facts, relevant case law and other potential remedies, if any that are available?  How do you think a Court would rule, given the available facts?  If a Court or Jury finds a Nuisance will an Injunction be granted?
