(2) Dr. Red   (а) Dr. Red оperаtes а medical clinic that serves a lоw incоme population, many of whom receive Medicaid.  Dr. Red is a dedicated general practitioner, and often works long days.  Dr. Red employs a billing specialist, Agatha, and a receptionist, Eugene.  Agatha sees how hard Dr. Red works, and believes his medical care is essential to the neighborhood.  When Agatha bills general patient appointments, she can bill 300A (an appointment for 20 minutes) or bill 600B (an appointment for 45 minutes).  Agatha starts to bill all appointments for 600B and submits the bills without informing Dr. Red.  Eugene hears Agatha talking on the phone, “Oh yes, Dr. Red is so busy.  He sees so many patients per day.  Just last week he worked a 65 hour week!”  Eugene knows Dr. Red took a two hour lunch last week with his wife Bunny, and took last Friday off to sail on his yacht.  Eugene wonders if something fishy is going on and wonders if Agatha billed Medicaid for many more hours than when Dr. Red was actually with patients.   (b) Eugene starts really digging into the billing records and patient files.  Eugene wonders if he can blow the whistle on Dr. Red. Agatha sees Eugene digging around in the records and fires him.  Eugene thinks it is really because Agatha found him searching through files and knows that he was going to report Dr. Red.  Eugene wonders if he has any recourse because he was fired.   (c) While he was digging around in Agatha’s files, Eugene also found four letters from Rose Pharmaceuticals from the past six months.  Each letter says, “Dear Dr. Red, We applaud you on your dedication to your patients.  We would like to reward your commitment to providing your patients our very best Statin Drug by showing our appreciation.  Please find enclosed a $150 gift card to Ulele Fancy Restaurant to enjoy dining at its finest.”  Eugene suspects Dr. Red had an inappropriate business arrangement with Rose Pharmaceuticals.
