(20 pоints) Due tо relentless cоmmerciаl whаling, the blue-grаy whale was hunted to near extinction in the 1930s and 1940s. Finally, in 1986 the International Whaling Commission (IWC) instituted a moratorium on commercial whaling of the blue-gray whale and many other whale species. At the same time, the United States placed the blue-gray whale on its list of endangered species and, concurrently with the listing, designated as critical habitat the species' entire Pacific Ocean range, which extends out to 50 nautical miles from the coast from the southern tip Mexico to the Columbia River estuary separating the states of Oregon and Washington. Since 1986, no intentional killing of blue-gray whales has occurred, although they face threats (and mortality) from ship strikes, entanglement in fishing gear, and noise. They remain endangered with just 500 animals in the wild. Scientists estimate that only 300 individuals are of reproductive age.  Despite the low numbers of whales, they tend to congregate and, consequently, a vibrant whalewatching industry has developed around blue-gray whales. At least 30 companies operate 60 boats; each boat takes roughly 20 whalewatchers to see the whales each day. Most of the boats are older fishing vessels that were converted to whalewatching boats when the Department of Commerce adopted individual fishing quotas for rockfish and left many fishers with no allocation and no fish to catch. These older boats tend to be noisy and tend to leak more oil than newer boats. Because of the below normal recovery rate of the blue-gray whale, scientists suspect that whalewatching is having a negative impact on the species, but they have not determined whether it is the noise, constant presence of so many boats, or discharges of oil from the vessels that is the cause of the low recovery rates.  Due to these concerns, Congress enacted the Whalewatching Safety Act (WSA). The WSA does not establish any specific permit requirements or conditions for whalewatching beyond those found in the Marine Mammal Protection Act (MMPA) and the Endangered Species Act (ESA). It does, however, require any operator of a whalewatching vessel to obtain a license from the Secretary of Commerce, through the National Marine Fisheries Service, prior to engaging in whalewatching. The Blue-Gray Whale Whalewatching Association (BGWWA), comprising all 30 companies, seeks your help is obtaining relevant permits to conduct whalewatching at existing levels; that is, 60 boats each taking roughly 20 whalewatchers to see the whales each day. Applying only the MMPA and ESA, explain to the BGWWA the process for obtaining their license and the likelihood that they will receive their license.
