Jerry wаs а rаcecar driver and he liked tо drive fast. Unfоrtunately, he alsо liked to drink too; in the last 5 years Jerry had been convicted twice of driving under the influence. However, Jerry believed that he drove better when he was drunk. About 5 minutes prior to the biggest race of the year, the “Small Town 500”, Jerry’s nerves were getting the best of him. Jerry drank half of a large bottle of whiskey and took his seat. As the race progressed, Jerry increasingly felt the effects of the alcohol. Jerry passed out and his racecar came to a stop while still on the track. The drivers behind Jerry, traveling at hundreds of miles per hour, had to sharply swerve to avoid hitting Jerry’s car. Bill was one of the drivers headed toward Jerry’s stopped car at great speed. Unfortunately, Bill was not paying attention. All Bill could think about was that he just found out a few hours prior that his wife was having an affair. Bill swerved at the last very second, causing his car to spin out of control and careen into a bystander, Victor, killing him instantly. Bill immediately ran as fast as he could toward Jerry’s car, which was still stopped in the middle of the track, shouting, “I’m going to kill you Jerry you stupid drunk!” Bill was furious that Jerry’s drunkenness resulted in Bill crashing his car into Victor. Bill then unsheathed his knife and was about to stab Jerry in the chest but police tased him at the last second. Bill and Jerry were taken into custody. This jurisdiction has adopted the common law, with modern distinctions where applicable. In this jurisdiction, Driving while Under the Influence is a misdemeanor. Should Jerry be charged with the Murder of Victor? Discuss. Should Bill be charged with the Attempted Murder of Jerry? Discuss.
