[TM4] Scоtty Mаyfield mаde а TV cоmmercial claiming the yellоw coloring on his milk container keeps out light, making the milk last longer. He even obtained a utility patent for the yellow-colored container. In the commercial, he says, “when you go to the grocery store, look for the yellow milk container.” Indeed, out of all colors, the yellow color achieves the best light balance so that the milk is preserved best. Shoppers eventually begin to identify a yellow-colored milk container with Scotty Mayfield’s brand of milk – thus the yellow had achieved secondary meaning.  Mayfield at this point decides to apply for a trademark for yellow in conjunction with the sale of milk containers.  Is it likely that Mayfield will succeed on getting (and maintaining) a trademark?
