Pаtty оwns аn оld hоuse in а large city. The house had belonged to her parents, and she grew up living in it. She has spent $120,000 on improvements to the house. While it would be seen as an ordinary house in most of the country, because of its’ location it is worth about 1 million dollars. Patty’s parcel is 100 feet wide and 300 feet deep. Patty’s house is one block from a large plant belonging to ABC Inc. The city has plans to allow ABC Inc. to build a light rail system between the plant near Patty’s house, and another facility ABC Inc. owns two miles away. The plan for the light rail foresees building an elevated track. One of the pylons supporting the track is planned for Patty’s large back yard. The elevated track will pass 100 feet from Patty’s house, and over the back 20 feet of her property. Because ABC operates 24 hours a day, and moves people and material between the two plants every 20 minutes all day and all night. The city asked Patty to sell the land for the pylon to the city, who will gift it to ABC Inc, but Patty rejected their offer. The city then served Patty with papers to take the land for the pylon – a 20 foot by 5 foot rectangle – by eminent domain. Patty Wants to stop the taking, but if she cannot, she wants compensation for the whole house, or if that fails, for the whole strip below the elevated track. What arguments can Patty make to support her desired outcomes? What arguments will the city use to justify their plan?
