Questiоns 5-7 аre bаsed оn the fоllowing fаct situation:  After a series of muggings within a four-square-block vicinity, police conducted a comprehensive sweep of the area. The mugger was described as a white male, about six feet tall, with blond hair and a goatee. While on patrol in this area, uniformed Officer O'Leary noticed Byron walking nervously down the street with his hands in his pockets. O'Leary could tell that Byron was white, about six feet tall, and had blond hair, but could not, from her angle of view, determine if he had a goatee. When O'Leary attempted to approach Byron for the purpose of determining if he had a goatee, Byron (having spotted O'Leary) hurriedly entered the apartment building that was closest to him. O'Leary followed him. When she saw Byron on the lighted stairway, O'Leary noticed that Byron did have a goatee and arrested him on the spot. After handcuffing and putting him in the squad car, but before reading Byron his Miranda rights, O'Leary asked Byron where he'd been at 9:00 P.M. on the preceding night (the date and time of the most recent mugging). Byron broke down and confessed to that mugging and several others. O'Leary then searched Byron's pockets and found a diamond ring, which was later identified as the one taken from a recent mugging victim. At the station, Byron initially claimed his innocence. However, when he considered his earlier confession and the ring, he agreed to plead guilty, based on a promise by the prosecutor of a reduced sentence. Soon afterward, however, Byron made a motion to permit withdrawal of the guilty plea and the entry of a not guilty plea. The court granted Byron's motion. At his trial, Byron took the stand and was asked just one question by his attorney, “did you commit the robberies with which you are charged?" Byron answered, “No.” The prosecution then attempted to cross-examine Byron. However, the prosecution was prevented from doing so by the court when Byron's attorney asserted the Fifth Amendment privilege against self-incrimination. The court also prevented the prosecution's attempt to introduce evidence of Byron's confession to O'Leary for the purpose of impeachment.
