“Miscоnduct оr а Test” Yоu аre а rookie police officer just out of the police academy. You graduated in the top 10 percent of the class and are thrilled to find out you are assigned to the 4th District Station, which is located in a busy area of the city. The district is crowded with numerous businesses, apartments, and a large University. You excited to be out of the academy and on your way to a successful career.     You are assigned to Field Training Officer (FTO) Rick Evans, a veteran of the police department with 16 years of service. Officer Rick Evans has trained a number of rookie officers and is well known and respected by all the police officers within the district. Officer Evans has been given several commendations for exceptional service and is a pillar of the community. You understand Officer Rick Evans and the department will expect a lot from you in the coming months. After speaking to the Captain of the District Station, you understand a rookie officer must follow all of Officer Evans commands in order to graduate the field training program. Your field training is typical of most rookie police officers including writing traffic tickets, writing numerous reports, and responding to calls for service. In the first month of field training, you learned a number of critical aspects of policing from Officer Rick Evans such as, proper report writing skills and evidence collection. During the second month of training, you and Officer Evans respond to a domestic violence call in progress. During the call the suspect Marco Williams grabbed a knife and attempted to stab you while you had your head turned speaking to the victim Eva Williams. Luckily, Officer Rick Evans tackled Marco Williams from behind before deploying his Taser on the suspect. You realized Officer Evans possibly saved your life or at least saved you from being harmed. You were extremely grateful of Officer Evans’ quick thinking and actions. After completing the arrest, you offered to buy Office Evans dinner, which he promptly refused, but advised you, “Never to turn your back on anyone, kid.” Officer Rick Evans was slightly cut on the hand during the altercation and even received an award from the department for his heroic actions during the event. During the following several weeks Officer Rick Evans taught you how to complete a Driving Under the Influence (DUI) arrest along with investigating underage alcohol parties and conducting follow-up investigations to hit and run accident reports. You and Officer Evans make several arrests involving drug offenders and your confidence as a police officer increases. You understand and realize the immense knowledge Officer Evans possesses and decided to model your policing style from Officer Rick Evans. On your final night of field training after three in half long months, Officer Rick Evans conducts your final evaluation. You are very excited and realize this is a major accomplishment in your professional life. In roll call, Officer Rick Evans says to you, “Don’t worry rookie, it will be an easy night for you, I guarantee it.” You smile and begin the shift as usual responding to routine calls for service, conducting traffic stops, and writing several reports.  Halfway through the night, Officer Rick Evans instructs you to leave the patrol sector you have been assigned and head towards the local university. You assume you will respond to a call for service or meet a fellow officer at the university for coffee or a late dinner. Instead, Officer Evans instructs you to park across the street from the university apartments/dorms. Officer Evans tells you to turn off your headlights. You follow his commands and after several minutes you ask Officer Evans what are you doing? Officer Evans responds, by saying, “I am checking the welfare of a female individual.” Officer Evans then pulls out a pair of binoculars he stored in the glovebox. You are confused but think maybe you are conducting a “sting” or undercover operation. Officer Evans states, “The second window on the third floor usually give a real good show on an average night.” The window is the bathroom of a female apartment/dorm complex. You cannot see anything without binoculars. You wait for approximately 5 minutes as Officer Evans continues to look through his binoculars.    Being a rookie officer, you do not know how to ethically respond to the situation and are highly confused. You are concerned because you believe the situation is a test. However, if it is not a test you do not want to be labeled a “rat” or a “snitch” early in your career. You are conflicted about saying anything to your supervisor since Officer Evans possibly saved your life less than eight weeks ago. After approximately 7 or 8 minutes, you leave the area to respond to a call for service in your sector. At the conclusion of the shift Officer Rick Evans writes you an outstanding final recommendation to the supervisor and believes you should graduate from the field training observation (FTO) program. Officer Evans states to your supervisor, “The kid did well and will be alright working with any shift.” You are thrilled to be out of the field training observation program and at the same time you are highly confused about the apartment/dorm room incident. Ethically, how should you respond to the incident? Do you believe this is a test or misconduct? Would you realistically respond differently to the situation if you were not a rookie police officer? Does Officer Rick Evans’ actions during the domestic violence call earlier in the year impact your decision-making? If so, how? What ethical system would you utilize to guide your decision-making in this situation? Why?
