APD Officer Allisоn hаs heаrd rumоrs thаt sоmebody might be selling drugs on McCollie Street in Turnagain, a neighborhood in Anchorage, but she does not know who. She decides to find out by picking up all of the trash left for collection on the sidewalk on McCollie Avenue, which has 15 houses. She gets an APD police van, activates the lights and siren, and collects all the garbage for the McCollie houses, causing a substantial disturbance. She sifts through the trash and finds some evidence that might indicate a drug operation; lots of baggies, a broken scale, a receipt for purchase of syringes, from an address where Eric lives with his elderly parents. While this raises her suspicions, Officer Allison does not think it is enough for a search warrant. As an APD Officer, she has access to flight manifests and watches until Eric has scheduled a flight out of and returning to Alaska. On his return, she is at the airport with her sniffer dog, Nuky. She finds the bags registered to Eric and Nuky alerts to the presence of drugs. Based on this evidence, she gets a search warrant for the bags and finds significant amounts of illegal drugs.  Eric challenges the search of his garbage and his bags. Please analyze these claims under Alaska’s Constitution and reach a conclusion on each. LAST 10 POINTS BONUS QUESTION: Please take all of the above facts, but this time it is FBI Agent Grace not an APD officer that does them. Please analyze Eric’s claims that the search of the trash and the bags were illegal under the US Constitution and reach a conclusion on each.

Officer Elenа receives а repоrt оn her rаdiо of the recent theft of a valuable bicycle owned by Olympic star Kikkan Randall, a distinctive bike painted gold to celebrate her gold medals with “Kikkan Rules” painted on the side. The theft occurred just moments ago in the Stuckagain area of Anchorage, a residential area that Officer Elena knows only has one access road to Anchorage and where there have been lots of bike thefts. Officer Elena is in the area and thinks this is a great opportunity to catch the thief. She immediately sets up a roadblock check point on the access road out of Stuckagain and plans to stop every car coming out of the area, asking the driver for ID and if they have seen any bicycle thefts. She sets up the roadblock check point and the first two cars do not raise any suspicions and she lets them go. The third car is driven by Eric. As she is asking for his ID, she sees in the back seat a gold bike with “Kikkan Rules” painted on the side. She arrests Eric and is a hero in Anchorage.  Eric challenges the stop under Alaska’s constitution. Please analyze this issue under the relevant caselaw and reach a conclusion about its validity. 5 POINT BONUS QUESTION: APD Office Sofie hears about the return of Kikkan’s bike and wants to be a hero too. She proposes setting up a number of “sobriety” check points in Anchorage to stop drunk driving. Officers will stop every car, ask for ID, ask if the person has been drinking, and look for any signs of intoxication. Please analyze this proposal under Alaska’s constitution and reach a conclusion about its validity.  ANOTHER 5 POINT BONUS QUESTION: Federal authorities in Alaska like this roadblock idea too. They propose that US customs agents set up a roadblock 10 miles into US territory near the Canada border and stop every car looking for undocumented persons. Please analyze the constitutionality of this proposal and reach a conclusion about its validity.  

Officer Sаbdielа pulls оver а car fоr having a brоken tail light at 2 am in December. The car is driven by Ryan and Eric is a passenger. She explains to Ryan the reason for the stop and asks for his license and registration, which Ryan gives to her. Eric appears very nervous. Officer Sabdiela asks both of them if they are armed. Ryan says no but Eric says he always carries a knife, and is registered to carry a firearm, although he does not have one on him. Officer Sabdiela asks both to step out of the car.  She performs a pat down search of Eric and feels two hard objects in his jacket pockets, each about 5 inches long. She removes both; one is a large pocket knife and the other is a long transparent vial of white powder with a syringe taped to it. Based on her training, it is immediately obvious to her that this is illegal drugs. She arrests Eric and places him in her squad car. She searches the area around the driver’s and passenger seats for weapons or drugs and does not find anything. She asks Ryan again if he has any drugs or weapons, and he says he does not. Without returning his license, Officer Sabdiela asks Ryan if she can search the trunk of the car, and he says yes. In the trunk, she finds a large bag of white powder, more syringes, and some loose cash. She arrests Ryan.  Eric and Ryan challenge the searches and seek exclusion of the evidence against them. Please analyze these claims under Alaska’s Constitution and reach a conclusion on each.
