Officer Pоlly Pоlice wаnts tо use some of the cool equipment APD hаs lying аround to identify people who might be illegally growing unregulated marijuana in Anchorage. She checks out the Acme Thermal Imaging camera, which takes pictures showing the heat signature of the outside of houses because grow operations often use high-intensity heat lamps. She drives around Anchorage using the special camera looking at houses. She also checks out the APD drone with special zoom camera and flies all over Anchorage looking for backyards that might be used for grow operations. David Defendant’s house shows an unusually high heat signature and, using the drone zoom camera, she can see mature marijuana plants in David’s fenced back yard right behind his house. David challenges Polly’s actions as violations of the US and Alaska constitutions. Please analyze David’s constitutional claims.

Officer Paul gets this information from dispatch and gets to the bar parking lot just in time to see a purple car leaving the bar parking lot, with a man driving and a woman passenger. He pulls the car over by activating his police lights. He has Harry roll down the window and notices 1) that Harry has bloodshot watery eyes and the strong smell of alcohol and 2) that Wilma has a small cut over her eye and a bruise on her face. Officer Paul conducts field sobriety tests on Harry, which he fails, and then places Harry in the back of his patrol car in handcuffs. Officer Paul returns to the purple car and asks Wilma if she is okay to drive home. Wilma says that she is. Officer Paul then asks Wilma if it is okay for him to search the trunk of the car and she agrees. In the truck, Officer Paul finds illegal drugs. Harry is charged with drunk driving, domestic assault, and possession of illegal drugs. He presents a constitutional challenge to 1) the stop of the purple car, 2) the field sobriety tests and his later drunk driving charge, and 3) the search of his trunk. Bonus Question (5 points):Same facts as above, except that when Harry, in the back of the patrol car, hears Officer Paul ask Wilma for permission to search the trunk, Harry yells out “No, I do not give consent to search the trunk.”  Officer Paul has another officer drive Harry downtown for booking, then turns back to Wilma and asks again for permission to search the trunk, and she says “yes”. For this bonus question, apply federal not Alaska law. Is the search of the trunk admissible under federal law?

Each of them are later arrested, placed in custody, and interrogated separately.  In Sabdiela’s interrogation, the officer properly gives the Miranda warnings and believes that he is recording the interrogation, but the recorder malfunctions and no recording was made.  Phoebe’s interrogation is properly recorded and you can hear the officer, who believes that Phoebe has already been read her rights, ask Phoebe “You have already been read your rights, correct?” and Phoebe answer “Yup”. Both confess to the crime.  Eric holds out under interrogation for days, refusing to admit he had anything to do with it. Frustrated one of the officers sticks a gun in Eric’s mouth and says he will kill him if Eric doesn’t confess. Eric confesses.  A) Before trial, the state requests permission to use each of their confessions in their case in chief. Please analyze whether each can be admitted in the prosecution’s case. B) In the alternative, the state asks permission to use each of the confessions if the defendants testify. Eric’s attorney has given notice that Eric intends to take the stand and blame it all on the other two. If Eric does this, the other two want to take the stand and say it was all Eric. Please analyze whether if each defendant takes the stand and makes a statement inconsistent with his confession, the state can use the confession for impeachment.
