Dallas was the owner of a demolition business. The City of Columbia hired Dallas to demolish an old building belonging to the City to make room for a new library. Dallas planned to plant dynamite charges around the building, detonate the dynamite, and then haul the debris away. Early on the morning of November 1, Dallas planted sticks of dynamite around the building’s perimeter that was to be destroyed. At that same time, Dallas wired the sticks of dynamite to a detonator. Dallas intended to detonate the dynamite on November 1st at 10:00 pm when there would be fewer cars and pedestrians in the area. Barriers and signs had been erected but the street running past the building had not yet been closed. At 5:00 pm on November 1, suddenly and unexpectedly, one of the planted sticks of dynamite spontaneously detonated. Peter happened to be driving by the building at the time of the unexpected explosion. A heavy piece of concrete was hurled away from the building due to the explosion and onto the street in front of the building where it struck Peter’s car. When the piece of concrete hit Peter’s car, it caused damage to the car and physical injury to Peter. Discuss a cause of action by Peter against Dallas for strict liability.

Wilber purchased a space heater from Delta, a retailer, to use in his garage while working on his car. Delta had purchased the space heater from a wholesaler named Sigma, who had purchased it from a distributor named Beta, who had purchased the space heater from the manufacturer, Alpha. After purchasing the space heater, and after bringing the space heater home, Wilber plugged the space heater’s electrical cord into a normal working electrical outlet in his garage. Wilber turned the space heater on and began working on his car. After a short time, Wilber smelled smoke and looked up to see that a fire had started near the space heater. Wilber retrieved a fire extinguisher and was able to put out the fire. However, while fighting the fire, Wilber’s arms and hands were burned and part of Wilber’s garage was damaged.  The investigation later revealed that one of the wires comprising the heating element had broken when heated. When the red-hot wire broke, it was ejected from the space heater, causing the fire. The investigation also revealed that the wire had broken because it had not been properly soldered at the time the space heater was made. Discuss.
