Dylаn аnd Dоug were twins, sаvvy and smart yоung men.  Ever since they were 10 years оld, they had regularly ridden their dirt bikes and competed in dirt bike races.  After saving their money over the years, they opened a dirt bike store called D&D Dirt Bikes and started selling used dirt bikes.   D&D Dirt Bikes located in Black Canyon City had an edge over their competitors because the store allowed prospective buyers the option of trying out a dirt bike for 24 hours with a small downpayment and discount on the purchase price of the dirt bike.  If a buyer decided to purchase the dirt bike, they had to provide proof of insurance before they could purchase the dirt bike.  Dylan and Doug’s background in selling dirt bikes (along with the fact they were both 17 years old) was listed on both the D&D Dirt Bikes website, as well as the pamphlet they handed out to customers when they purchased a dirt bike.  They also made sure their pamphlet and information on their website included the following language: “Upon payment in full of the purchase price of a dirt bike, purchaser agrees that D&D Dirt Bikes will not be responsible for any damage to the property or injuries to the person operating the purchased dirt bike.” Phillip had recently moved to Black Canyon City, Arizona, and been teaching history classes at the local high school, and he had recently learned from his students about the Table Mesa Recreation Area, a large desert riding area located about an hour away.  Since he had always been curious about dirt biking, he decided he wanted to check it out for himself, but he first needed to purchase a dirt bike.  One Friday afternoon after school was over, Phillip drove to D&D Dirt Bikes store to look at dirt bikes.  Dylan immediately approached him as he saw that Phillip was eyeing the new Eurostar Rockstar dirt bike that was displayed in the window.  “We just got that Rockstar on Monday,” Dylan told him.  When it was new, it was worth $10,000.  Only one owner, and he had it less than a year then decided to get a newer model.  We think it’s a pretty good deal at $6,000.”  Noticing that Phillips’s eyes were lit up admiring the Rockstar dirt bike, Dylan told him the dirt bike was in excellent condition with “no issues.”  He didn’t disclose to him that there had been recent repairs to the brake pads, and some potential customers had complained about the unpredictability of the brakes. Even though he knew he did not have insurance, Phillip handed Dylan a document and said, “Here’s a copy of my insurance.”  Because Doug wasn’t in the store and he had a lot of customers who needed assistance, Dylan quickly took a copy of the document and had Phillip sign the agreement and took his $6,000 payment.  He only later discovered that the document was a copy of Phillip’s driver’s license, not a copy of his insurance card.  One week later, Dylan and Doug received an email from Phillip explaining that he was going to take “appropriate action” after the Rockstar dirt bike was totaled due to the faulty brakes. Discuss all legal theories Phillip may have to sue Dylan, Doug and D&D Dirt Bikes. Discuss any defenses Dylan and Doug could raise to these legal theories.
