Dustin had operated a commercial fishing business for 10 years in Miami, Florida, and often sold his premium fish to nearby restaurants. Philip owned a restaurant in Hilton Head, South Carolina and was thinking about moving to Florida and opening a seafood restaurant in Miami. When Dustin learned about Philip’s plans, he encouraged him to move out and assured him that if he opened his restaurant at that location, his commercial fishing business would sell him premium deep-sea fish (such as mahi mahi) that the other restaurants could not obtain. He also suggested that they could have a profitable business exchange where Philip could pay for the fishing equipment (such as rods and reels, fishing lines, hooks, and baits) while Dustin could provide significant discounts for Philip’s purchase of premium deep-sea fish for Philip’s restaurant. If Philip moved to Miami, Dustin said he would give him $1,000 due to his gratefulness for Philip’s actions in saving his life during the Gulf War. Dustin also assured Philip’s restaurant would receive the first catch for the season from Dustin’s commercial fishing business as a token of his great appreciation for Philip saving his life. Dustin confided in Philip that he felt guilty for not staying in touch with him over all these years and wanted to find a way to help him, even though it would not be comparable to Philip saving his life.
