Support: Cell phones allow businesspeople to do two jobs at once—go to an appointment and make a business phone call. If a car occupant is going to be late for a business or family event because of traffic, he or she can call and change the time of the meeting. People with cell phones can report accidents the minute they happen.   Which point is adequately supported by all the evidence above?

Ultrааwesоme Heаlth is a vertically integrated healthcare cоrpоration.  In southern Kentucky, it owns two general hospitals, 5 urgent care clinics, 3 ambulatory surgical centers (outpatient surgical services), and is the only ambulance service provider in a 10-county area including areas where other public and private healthcare facilities compete with Ultraawesome.  Ultraawesome, always seeking additional revenues, is considering two transactions: Using its control over the only ambulance service in the region to divert potentially profitable cases to Ultraawesome facilities and financial losers to facilities owned by other corporations, without regard of the distance to Ultraawesome facilities or those owned by others. Like any other healthcare corporation, Ultraawesome purchases its “durable medical equipment” (canes, crutches, wheelchairs, hospital beds, infusion pumps, etc.) from medical equipment suppliers. There are only three suppliers in the region that sell a complete range of durable medical equipment rather than just a few types.  Ultraawesome approaches the largest of these, Equipment for More, and makes an offer: Ultraawesome will purchase only from Equipment for More and at a 5% markup if Equipment for More agrees not to sell equipment to Ultraawesome’s competitiors. Following a complaint by Ultraawesome’s competitors to the FTC contesting the proposed transactions, the FTC investigates and decides to prohibit both.  Ultraawesome contests the decision in Federal District Court.  Should the judge overseeing the case use the rule of reason or “per se” violation doctrine to decide the cases, and why? Should the potential transactions be deemed a violation of antitrust law, and why or why not? (3-4 sentences)
