One night Art wаs driving dоwn а street in а high crime area with his girlfriend Brenda. He оbserved Officer Jоhnson’s police car parked on the side of the street. Art suddenly made an immediate and illegal left-hand turn, hoping that he had not been noticed by the police officer. He then hit the gas pedal and reached an excessive rate of speed before he noticed the flashing red light of Officer Johnson’s vehicle fast approaching him. Art then pulled his car to the side of the road. Officer Johnson approached Art and asked for his license and registration. Art complied with the request, but Officer Johnson then asked Art and his girlfriend to exit the vehicle and place their hands on the hood of Art’s car. Officer Johnson first did a pat-down of Art. In frisking his outer clothing, he came upon a hard object in Art’s jacket pocket. Officer Johnson seized it, and it was rock cocaine. Art’s girlfriend, Brenda, was then frisked by Officer Johnson. Brenda had a purse strapped over her shoulder. When Officer Johnson was frisking her, he could see a small handgun in her purse and immediately reached into the purse and retrieved the weapon. Art and Brenda were then arrested, handcuffed and placed in the back seat of Officer Johnson’s police car. In the process of placing Brenda in the vehicle, she became very argumentative with Officer Johnson and asserted that “you have no right to put your dirty hands on me and to violate the privacy of my purse.” Officer Johnson responded by banging Brenda’s head against the roof of his police car as he shoved her into the back seat of his vehicle.Brenda needed to have three stitches in her head due to this incident. In the meantime, Officer Johnson began a search of the interior of Art’s car and found several additional packets of cocaine under the font seat of the vehicle. Officer Johnson then called for assistance and Art’s vehicle was taken to the police impoundment lot. Officer Kennedy was assigned the job of collecting valuables that might be found in Art’s car. Although the police department had a set of clearly established procedures, when the officer looked through the trunk of Art’s car, he removed the spare tire and found additional baggies of cocaine in the wheel well of the trunk. Discuss all legal issues relating to (1) Pulling Art’s car to the side of the road; (2) the seizure of the rock cocaine from Art; (3) the seizure of Brenda’s gun; (4) the encounter between Brenda and the officer at the police car; (5) the seizure of the cocaine from the interior of Art’s car; (6) the seizure of the cocaine from the trunk of Art’s car.
