Wanda went to the hospital.  At the same time that she was there, her twin sister, Wilma, was also in the hospital, for a tummy tuck.  A nurse mistook Wanda for Wilma and wheeled her into the surgery room.  The surgery that Wilma was supposed to undergo was accidentally performed on Wanda. Unfortunately, Wanda was a hemophiliac and bled profusely.  Five days later, she passed away. Wanda was a waitress who made approximately $100/day. Wanda’s total medical costs are $5,000. Does Wanda’s husband, Hal, have any valid claims against Disney?  Does Hal have any valid claims against the nurse?  Do not discuss vicarious liability.  Can Disney claim any valid defenses?

Victоr wаs struck by а cаr and taken tо the emergency rоom (“ER”) immediately after the accident. Victor was treated by an ER doctor and released 30 minutes later. Victor later went to his own physician for a follow-up. Victor filed suit against Darnold, the driver of the car that struck him. Victor’s attorney objected on the grounds that his client wished to invoke the jurisdiction’s physician-patient privilege.How should the court rule on the objection?
