He testified that she excitedly replied to his questions by stating that “The red car ran through the red light.” (b) At the trial the plaintiff then proceeded to ask Officer Johnson about a young man who was riding his bike and had stopped for the red light. Officer Johnson had written into his police report that “the young man stated that the red car ran the light.”(c) At the trial the plaintiff called as his second witness the ex-girlfriend of the defendant who was a passenger in the red car when the accident occurred. She testified that she told the defendant just before the accident that “I am closing my eyes and holding my breath because of how fast you are going.”(d) As his final witness at the trial, the plaintiff called Doctor Kennedy who had examined the plaintiff following the accident.
