Dаvid is а single mаn. David has had trоuble finding anyоne with cоmmon interests to date in his small community. One day, David was at home recovering from the sedation involved in a routine medical test. Since he did not feel up to doing any kind of work David was browsing the internet. David ran across an ad for Presbyterian Partners Place (PPP). The ad said PPP is an online dating service. PPP advertised itself as “the solution for conservative Presbyterian Christians who love the culture of Lewis and Tolkien who need to find each other in the postmodern world.” The PPP ad said that they have “5000 female subscribers who are Bible believing Presbyterians, political and social conservatives, and lovers of museums, classical music, books, ships, forests, and adventures.” This exactly the kind of woman David was looking for.  He found the woman in the PPP ad very attractive. He saw the representations about the large number of women just like what he was looking for. David clicked rapidly through all the contractual boiler plate without paying any attention to it. He knew his mind was still too foggy to handle anything that confusing. He agreed to the one-year subscription for $50 per month for 12 months and entered his credit card number. The web Site said this was a special discount price and would only last for 30 minutes. David began searching through the pages of alleged female members, but he could not find any whose profile matched the descriptors in the ad. In fact, nearly all of them had factors David considered red flags that seemed very contrary to the character of the persons highlighted in the ad. Two days later David saw a news video about PPP. A reporter, Abby Penworthy, had researched PPP and gone under-cover as a member and as an employee. The reporter noted that the PPP used computer data to determine what kind of significant other the potential customer was looking for and then touted that sort of person in an AI tailor made ad directed at the individual. All the ads said there were 5000 members like whatever they were looking for. The ad even customized the name of the dating service and created a personalized interface with that name. When asked about the deceptive nature of the system, PPP executives said it was their opinion that their membership must have people like they were suggesting it had, although they had not counted them or reviewed the profiles of the members to confirm their opinion. The reporter also said many of the accounts were bots, not real people. The reporter could not confirm the bots were created by PPP, but that seemed the most logical assumption. David contacted the reporter Abby Penworthy about his experience. The two fell in love and married in four months. Once engaged to Abby, David tried to cancel his membership in PPP now that he no longer needed or trusted it. PPP refused to release him from the contract. David instructed his credit card company not to make any more payments. PPP sued David for breach of contract in small claims court. Discuss any defenses David may be able to assert in good faith. Evaluate the strength and weakness of each defense.
