The Fury, а wоrld-fаmоus heаvy metal band, was scheduled tо give a concert on the lawn at night in downtown Colombia, a major city. Fans loved the concerts because of the loud music, the amazing pyrotechnics, and the general chaos. The band threw things into the crowd as part of the show at every concert, and most of the concert attendees consumed alcohol or marijuana or both during the concerts. Due to the expected level of intoxication, the Colombia Police Department deployed a large team of uniformed police officers to circulate among the concert attendees for safety during the event. Halfway through the concert, while the energy was high and the music loud, the drummer threw his drumsticks into the crowd, to a roar of applause. One of the drumsticks hit Colombia Police Officer Nichols in the back of the head, and the other drumstick hit Ricky, a dedicated fan who loved the concerts and had attended many times before. Both were knocked unconscious and sustained serious head injuries. Immediately after, the planned pyrotechnics display began. The lead singer started jumping and headbanging in time to a song, and the crowd copied him. The staging and equipment started rocking and swaying in reaction to the force of the jumping. One of the pyrotechnic towers tipped over, and fire began to spread. Some of the crowd started to flee the flames, injuring Zach, who was knocked down and trampled. Others who were more intoxicated thought the mayhem was part of the show and kept jumping. As the jumping continued, lights and speakers on the stage started falling into the crowd, injuring Ash. Ash was intoxicated, and had not realized that he needed to move to avoid being hit by the falling equipment. Fortunately, law enforcement moved quickly to stop the concert and prevented a major stampede. The pyrotechnics team worked quickly to extinguish the flames. The members of the band, The Fury, were all equal partners in a partnership arrangement, and the drummer had hired a crew local to Colombia to install the staging. The crew were college students, who had installed the staging in exchange for free tickets and backstage access with “refreshments” before the show. Discuss the liability of The Fury to: (1) Officer Nichols; (2) Ricky; (3) Zach; and (4) Ash.
