Art, а resident оf the nаtiоn’s cаpitоl, had been hearing voices in his head which he concluded came from the chief of an alien civilization known as the Klingons. He was instructed that he must obtain documents from the home of the Chairman of the House Science and Technology Committee. The voice informed him that these documents contained classified information concerning the existence of Unidentified Aerial Phenomena. In one of the communications, the voice provided Art with what he realized was the combination to a safe. The voice then warned Art that his failure to complete this assignment would result in the destruction of the capitol. Coincidently, the committee chairman happened to live in a townhouse just down the street from where Art himself lived. So, that evening around midnight, Art picked the lock on the front door of the chairman’s townhouse and entered the residence. Donning a ski mask and armed with a semi-automatic pistol, Art was prepared to do whatever was necessary to carry out this task. However, when he searched the front rooms and office of the residence, he found no safe. He did find a brochure relating to an amusement park in nearby Virginia featuring a new ride billed as Space Mountain. The voice in his head confirmed to him that the brochure was code written to hide its true meaning, so Art seized it and ran down the street to his own residence. Several hours later, after showering and eating breakfast, Art walked out onto his front porch and observed the chairman approaching his residence with two large men from a private security firm. The voice in his head told him that this was proof that the chairman himself was part of the alien conspiracy. So, Art retrieved his firearm from a nearby table inside the front door and shot at the chairman, missing him by inches. One of the security guards then returned fire, hitting Art in the shoulder, causing him to drop his firearm. The other guard then apprehended Art, and the police were summoned to the scene of the crime. Discuss all legal issues relating to the following: (a) Art’s entry into the chairman’s townhouse; Apply modern statutory law. (b) Art shooting at the chairman; Apply the common law. (c) Any defense(s) the security guard may raise for shooting Art; Apply the common law. (d) Any defense(s) that Art may raise for his criminal activity; Apply the Model Penal Code.
