Officer Jоnes wаs wоrking аs а DUI enfоrcement patrol officer with duties to target individuals driving intoxicated. Officer Jones began patrolling around the "bar break" and he observed a vehicle pull into traffic from a local bar. As the car left the parking lot, it failed to use its turn signal and Officer Jones initiated a stop. Upon contact with the driver Mr. Marquez, he noted the smell of alcohol and observed slurred speech as well as glassy, watery and bloodshot eyes. Officer Jones asked Marquez to step out of the vehicle and Officer Jones observed erratic actions, including mood swings from calm cooperation to agitation. Based on his observations, Officer Jones suspected Marquez was both under the influence of alcohol and under the influence of a controlled substance. Officer Jones performed field sobriety tests on Marquez and he performed poorly on all of them. Marquez was arrested for OUI and at the Anchorage Jail, Marquez provided a blood alcohol breath sample of .163 grams per 210 liters of breath. Officer Jones had a drug-sniffing dog walk around Marquez's vehicle and the dog alerted to the presence of drugs.
