The terms of the Act are: The Florida Supreme Court shall have jurisdiction to review any decision of a district court of appeal affirming a final judgment exceeding one million dollars that is based upon a jury verdict. Any rule of procedure promulgated by the Florida Supreme Court shall be presented to the governor for approval in the same manner as a bill passed by the legislature. Any claim of medical malpractice shall be tried before an administrative hearing officer. The hearing officer shall determine fault and award damages in accordance with existing law. Any final order may be appealed to the First District Court of Appeal. Please prepare a memorandum of law analyzing the provisions of this Act including their validity under Florida law. The memorandum should only address claims that arise after the effective date of the Act.
