Midterm ExаmEvidence 1Fаll 2026Prоfessоr Kevin Hоlsclаw Art was walking his dog at the park and was approached by Ben, an undercover narcotics informant used by the local police department.  Ben observed that Art wore his hair in a ponytail and was a good target for a drug deal.  So, Ben asked Art if he would like to buy some “nose candy.”  Art responded that “I haven’t done coke for several years and am not really interested.”   Ben responded, “please help me out because my mother is receiving cancer treatments and anything you could do to help me out could make a difference.” Art’s own mother had died that same year from cancer.  And he took the bait. He had $200 dollars in his pocket he had reserved to fill his truck with gas and handed the money to Ben. The latter then placed a baggie of cocaine in Art’s hands and within a few seconds narcotics officers descended on scene and placed Art under arrest.  Following his arrest, Art sought to negotiate a fine only plea agreement with the police.  During the negotiation Art admitted that he agreed to buy the cocaine.  The negotiations soon fell apart, and Art withdrew from any further communications with the officers.  Art then hired a lawyer, and the case went to trial.(a) The prosecutor called as a witness the police officer who had attempted to negotiate the plea deal with Art.  He testified that Art stated he agreed to buy the cocaine.  (b) In his opening argument, Art’s attorney asserted that they would prove that this was a clear case of entrapment. Accordingly, he later called Carl to the witness stand who testified that Art had counseled his son about the dangers of illegal drug use.  © The defense attorney called Art’s friend Elise to the witness stand who testified that in her opinion Art had been emotionally devastated by the loss of his own mother to cancer and would do anything to help someone in the same situation. (d) A former partner of the officer who arrested Art was called as a witness by the defense counsel. He testified that they wrote a note to Ben informing him that unless he could facilitate more arrests, he was going to do time for his own illegal drug activities.  Despite repeated attempts to obtain the note and the service of subpoenas on both the arresting officer and Ben the note could not be obtained. The witness testified under oath  that he did not have a copy of the note. Discuss all legal issues relating to how a court would rule on the admissibility of the evidence discussed above. This jurisdiction follows the Federal Rules of Evidence.
